Welcome to our School Management System. These Terms of Service govern your use of our platform and services. By accessing or using our services, you agree to be bound by these terms.
1. Acceptance of Terms
By registering for an account or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you are entering into these terms on behalf of a school or educational institution, you represent that you have the authority to bind that entity to these terms.
2. Account Registration
2.1 Eligibility
To register for an account, you must:
- Be a legally recognized educational institution or have authority to represent one
- Provide accurate and complete registration information
- Be at least 18 years old if registering as an individual
- Maintain the security of your account credentials
2.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other security breach.
3. Subscription Plans and Pricing
3.1 Available Plans
We offer the following subscription tiers:
- FREE: 30-day trial with all premium features (200 students, 20 teachers limit)
- STARTER: 50,000 TZS/month (100 students, 10 teachers)
- BASIC: 75,000 TZS/month (200 students, 20 teachers)
- STANDARD: 120,000 TZS/month (500 students, 50 teachers)
- PREMIUM: 200,000 TZS/month (1,000 students, 100 teachers)
- ENTERPRISE: 350,000 TZS/month (unlimited students and teachers)
3.2 Free Trial
New schools may register for a 30-day free trial. During the trial period:
- All premium features are available
- Usage is limited to 200 students and 20 teachers
- No payment information is required
- The trial automatically converts to the FREE plan after 30 days unless a paid plan is selected
- Only one trial per school is allowed (see section 3.3)
3.3 Trial Abuse Prevention
To prevent abuse of our free trial system:
- Each school is limited to one free trial registration
- We use multiple verification methods including school name normalization, phone number verification, and IP-based rate limiting
- Attempts to register multiple times for free trials may result in account suspension
- IP addresses are limited to registering 2 schools within any 30-day period
3.4 Billing Cycles
Paid subscriptions are available in the following billing cycles:
- Monthly: Full monthly price
- Quarterly: Monthly price × 3 (no discount)
- Annual: 20% discount on annual price (equivalent to 9.6 months of monthly pricing)
4. Payment Terms
4.1 Payment Methods
We accept the following payment methods:
- Mobile Money (M-Pesa, Airtel Money, Tigo Pesa)
- Bank Transfer (manual processing)
4.2 Auto-Renewal
Paid subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will receive a notification before each renewal.
4.3 Payment Failure
If a payment fails:
- Your account will enter a 7-day grace period
- You will receive payment reminders
- After 7 days, your account will be suspended
- After 30 days of non-payment, your account may be terminated
4.4 Refunds
We offer refunds under the following conditions:
- Technical issues preventing service usage that we cannot resolve within 48 hours
- Duplicate payments
- Refunds are processed within 14 business days
- No refunds for partial months of service
5. Service Usage and Limitations
5.1 Acceptable Use
You agree to use our services only for lawful purposes and in accordance with these terms. You shall not:
- Use the service to store or transmit illegal content
- Attempt to gain unauthorized access to other accounts or systems
- Interfere with or disrupt the service or servers
- Use the service to send spam or unsolicited communications
- Violate any applicable laws or regulations
5.2 Data Responsibility
As a school using our platform:
- You are responsible for obtaining necessary consents for student data collection
- You must ensure data accuracy and completeness
- You must comply with applicable data protection laws
- You grant us a limited license to process data to provide the service
5.3 Usage Limits
Each subscription tier has specific limits:
- Maximum number of students, teachers, and staff
- SMS message limits per month
- Storage space for documents and files
- API request limits
Exceeding these limits may result in additional charges or service restrictions.
6. Intellectual Property
6.1 Our Rights
We retain all intellectual property rights in the service, including software, documentation, and trademarks. You are granted a limited, non-exclusive, non-transferable license to use the service for your school's internal operations.
6.2 Your Content
You retain ownership of all data and content you upload to the service. By uploading content, you grant us the rights necessary to provide the service, including storage, processing, and backup.
7. Data Protection and Privacy
Our handling of personal data is governed by our Privacy Policy. We implement appropriate technical and organizational measures to protect your data. However, you are responsible for:
- Ensuring you have proper consent for student data
- Maintaining appropriate access controls within your school
- Complying with applicable data protection laws
8. Service Availability and Support
8.1 Uptime Commitment
We strive to maintain 99.5% uptime for our core services. Scheduled maintenance will be announced in advance when possible.
8.2 Support Levels
Support availability varies by plan:
- FREE, STARTER, BASIC: Email support during business hours
- STANDARD, PREMIUM: Priority email and chat support
- ENTERPRISE: 24/7 priority support with dedicated account manager
9. Termination
9.1 By You
You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial billing periods.
9.2 By Us
We may suspend or terminate your account if:
- You violate these terms
- You fail to pay for services
- We discontinue the service
- Required by law or legal process
9.3 Data Export
Upon termination, you may export your data for 30 days. After this period, data may be permanently deleted from our systems.
10. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid for services in the 12 months preceding the claim
- We are not responsible for data loss beyond our standard backup procedures
11. Changes to Terms
We may update these terms from time to time. We will notify you of significant changes via email or in-service notification. Continued use of the service after changes constitutes acceptance of the new terms.
12. Governing Law
These terms are governed by the laws of Tanzania. Any disputes shall be resolved in the courts of Tanzania.
